Our offers are non-binding, meaning we are not obligated to fill orders in the event of lack of availability. Product presentation in the online shop is a non-binding online catalog and not a legally binding offer. However, by clicking on the button “Place order” you place a binding order for the products in your shopping cart. Receipt of your order occurs instantly, as does the subsequent confirmation of your order via the automated confirmation e-mail sent by us. With this e-mail confirmation, the sales contract takes effect. The contract is subject exclusively to Austrian law.

The goods will remain property of Baron Filou GmbH until such time as the buyer has paid all outstanding dues.

Payment in advance

The goods will remain property of Baron Filou GmbH until such time as the buyer has paid all outstanding dues. Baron Filou GmbH only accepts orders if payment is made in advance.

Payment after the receipt of goods

Baron Filou does not offer the service of paying after the receipt of the goods. Everything needs to be paid in advance.

Shipping within the EU & Shipping Costs

Baron Filou ships to all countries within the European Union.

For deliveries within the European Union, the VAT (Value Added Tax) rate of the respective country will be charged (destination principle).

Shipping outside the EU & Shipping Costs

Import duties, taxes, and additional charges outside the EU

For deliveries outside the European Union, no VAT will be charged by Baron Filou.

Please note that items shipped outside of the European Union may be subject to import duties, taxes and/or charges, which are not included in the total cost of your order or included in the cost of shipping. These fees are not covered or reimbursed by Baron Filou.

Any additional charges for customs clearance are the responsibility of the recipient specified on the delivery address, as BARON FILOU does not have any influence on such costs. If a customer refuses the import duties, taxes and/or charges on their package, BARON FILOU is not liable for the package, and it will be disposed by the courier service. Please note that refunds will not be provided by Baron Filou for any refused shipment.

We recommend checking with your country’s customs office to determine if any additional fees apply. When customs clearance procedures are required, it can cause delays beyond the original delivery estimates.

We offer free delivery to the United Kingdom on all orders above 49 €.

Shipping address

Please be sure that the address label is correct to ensure correct delivery of all items ordered. Delivery to post office boxes or poste restante deliveries are not possible.

Please note that the delivery of your items can be significantly delayed if you enter your address wrongly or enter an address where the carrier does not reach you. Any package returned to Baron Filou GmbH or to our logistic partner due to the above incorrect and/or insufficient information will require an extra delivery charge paid by the customer before the package can be despatched again.

Baron Filou GmbH is not liable for damages and problems resulting from third parties accepting packages. Please make sure that every shipment will be received by an authorized person and speak to delivery personnel concerning this matter, should suspicions arise.

Delivery time

The goods will be shipped as soon as possible after the payment has been received on the account of Baron Filou GmbH. In case of delayed delivery, we will inform you in due time.

The regular delivery time depends on the actual bought product and the delivery country. An exact disclosure of shipping time per country can be found under “Shipping within the EU” and “Shipping outside the EU” within the “Shipping & Delivery” section. The delivery period starts one day after receipt of your order.

Delivery within Russia

Paying for the goods, you enter into a public contract with JSC “Russian Post” (browse the public contract text on https://customs.pochta.ru/oferta), which is an Authorized Operator for the purposes of declaration of goods sent by international mail and payment of customs duties regarding such goods. Baron Filou GmbH is not responsible for your obligations to pay customs duties and declare goods, as well as for the performance of its obligations to you by the Authorized Operator (as mentioned above) in accordance with the public contract. In accordance with these terms and conditions, you authorize Baron Filou GmbH to transfer information about the number and date of your order to the Authorized Operator, as well as the number of payments to be made in accordance with the requirements of Russian legislation and law of the Eurasian Economic Union connected with the declaration of goods and payment of customs duties. Baron Filou GmbH is not responsible for processing your payment and for processing of the data provided by you to the Authorized operator and is not involved in any way in these transactions.

COVID-19

Please be mindful that you may experience unusual shipping delays due to the COVID-19 pandemic, and standard shipping times may not apply. The standard shipping times do not include weekends, holidays and any unforeseen delays that may arise with the courier service.

Returns

Returns because of cancellation

Valid for all countries, except Russia: The buyer may withdraw from the sales contract by contacting Baron Filou GmbH directly, in writing (e.g., letter, e-mail to contact@baronfilou.com) within 30 days without needing to provide reasons. The deadline is calculated according to the date on which the buyer or third person nominated by the buyer, has taken possession of the goods.

The buyer/customer must bear all costs for return delivery himself. Within the European Union, there will be no additional import duty costs, taxes, or other charges.

If you would like to exchange the goods, please contact contact@baronfilou.com with your full name and your order number and information if you wish for a return or an exchange for another size or another product. Our customer service will then give you the instructions for the return/exchange.

Gift Cards cannot be returned or refunded.

We do not offer refunds or exchanges on swimwear if the original packaging has been opened, due to hygiene reasons.

Russia: Unfortunately, we cannot accept any order returns from Russia.

Returns because of exchange

Valid for all countries, except Russia: You have the choice to exchange the articles for a different size or to choose a completely different article. The items will be exchanged within 30 days. Please note that we can only accept unused articles with the original labels.

The buyer/customer must bear all costs for return delivery. The items should be returned in the original packaging without any visible signs of wear or damage. Please notice that we cannot accept the products if there are any traces of makeup, fragrances, or similar markers of use. The costs for the delivery of the new/exchanged products are carried by Baron Filou.

If you would like to exchange the goods, please contact contact@baronfilou.com with your full name and your order number and information if you wish for a return or an exchange for another size or another product. Our customer service will then give you the instructions for the return/exchange.

Russia: Unfortunately, we cannot accept any order returns from Russia.

Processing and refunds

Upon receiving and reviewing your return, you will receive a refund within 14 days of receipt of the return. The refund will be credited to the same account used at the time of purchase.

We place great emphasis on a thorough and quick processing of your return. However, delays of 2-3 workdays may occur during season kick-offs, high amounts of incoming orders, and the holiday season. We appreciate your patience and understanding.

Notice of Cancellation Policy and Withdrawal Agreement

Consumers have a right to withdraw from the sales contract within 30 days. Any individual concluding a legal contract to purchase products or services for his/her personal use is considered a consumer.

Right of cancellation

Valid for all countries, except Russia: The buyer may withdraw from the sales contract by contacting Baron Filou directly, in writing (e.g., letter, e-mail) within 30 days without needing to provide reasons. The deadline is calculated according to the date on which the buyer or third person nominated by the buyer has taken possession of the goods. Russia: Unfortunately, we cannot accept any order cancellations from Russia.

Consequences of cancellation

By cancelling this agreement within the specified deadline (30 days), we are obliged to repay all payments that we have received from you including delivery charges (except for additional costs arising from choosing a different type of delivery to the cheap, standard delivery offered by us) without delay and at the latest within 30 days from the date on which the notice of cancellation of this agreement is received. The reimbursement of the repayment will be the same means of payment that the buyer used in the original transaction, unless otherwise stipulated; under no circumstances will the buyer incur extra expenses. We have the right to withhold the reimbursement until the goods have been received.

The buyer shall receive the refund within a maximum of 14 days from the date on which the agreement was withdrawn or the goods returned. The deadline is granted if the goods have been sent within the 14 days’ expiry period. The buyer must bear all costs for return delivery. Within the European Union, there will be no duty cost. If you send back the product from outside of the European Union, all duty costs and fees must be covered by yourself (Incoterm DDP). The buyer is only required to reimburse for damaged goods if it is established that the damage was directly due to the event of mishandling of the goods by the buyer.

Ownership Rights

The ownership of the goods remains with Baron Filou GmbH until the payment is received in full.

Data protection

The protection of your personal data is very important to us. Therefore, we process your data exclusively based on the legal regulations in Austria (DSGVO, TKG 2003). Our Privacy Policy describes how we collect and process your personal data through our website (www.baronfilou.com), other selling platforms, and at events.

Copyright

The content, design, and texts of our catalogues and our online shop are the intellectual property of Baron Filou GmbH and are protected by copyright. The use of any pictures, texts, logos, and designs without the written permission of Baron Filou GmbH is illegal and will have legal consequences.

Contract language

The language for the contract is English. Any translations into other languages only serve as support – they are supplied without liability and are not legally binding for Baron Filou GmbH.

Liability

Baron Filou GmbH shall only be liable for damages incurred through malicious intent or gross negligence of Baron Filou GmbH. In the case of a breach of major contractual obligations, Baron Filou GmbH shall be liable for every culpable behavior of its employees. The specific manufacturers of our products shall be liable for the products that Baron Filou GmbH dispatches.

Baron Filou GmbH shall not be liable for indirect damages incurred, especially not for lost profit, unless the damage is caused with intent by employees of Baron Filou GmbH or with intent and gross negligence by legal representatives and executive staff of Baron Filou GmbH. In cases where there has neither been the malicious intent of employees nor intention or gross negligence of legal representatives and executive staff, Baron Filou GmbH is only liable for the amount that would cover typical damages foreseeable at the time the contract is concluded. The company Baron Filou GmbH shall not be obligated to provide continuous and uninterrupted availability of the website and is not liable for technical or electronic errors of the online offers. Baron Filou GmbH shall not be liable for damages caused by unauthorized persons shopping at the online shop of Baron Filou GmbH with the help of a password allocated to an authorized user.
